第一条 中华人民共和国国籍的取得、丧失和恢复,都适用本法。' F: h# q& {+ I1 d
第二条 中华人民共和国是统一的多民族的国家,各民族的人都具有中国国籍。. d8 }5 Y/ E7 q- u
第三条 中华人民共和国不承认中国公民具有双重国籍。
: t3 g e" A; ~8 Z! s9 F 第四条 父母双方或一方为中国公民,本人出生在中国,具有中国国籍。* G# r/ n1 h7 _; F
第五条 父母双方或一方为中国公民,本人出生在外国,具有中国国籍;但父母双方或一方为中国公民并定居在外国,本人出生时即具有外国国籍的,不具有中国国籍。# O9 ~3 _, F/ ^. B8 r
第六条 父母无国籍或国籍不明,定居在中国,本人出生在中国,具有中国国籍。6 X6 `4 P& [2 e7 ^( I( B
第七条 外国人或无国籍人,愿意遵守中国宪法和法律,并具有下列条件之一的,可以经申请批准加入中国国籍:
1 m9 D: v2 W6 a$ k4 Q' _. y 一、中国人的近亲属;* b0 ?9 I4 p6 G) S8 S' I
二、定居在中国的;
7 s9 }2 j+ h- Y! B3 t0 x8 T 三、有其它正当理由。
8 ]8 }5 _4 v( y7 E- m | 第八条 申请加入中国国籍获得批准的,即取得中国国籍;被批准加入中国国籍的,不得再保留外国国籍。" w( y I. z3 h+ f' g, n3 a2 _
第九条 定居外国的中国公民,自愿加入或取得外国国籍的,即自动丧失中国国籍。9 l. p4 r6 U- T2 W# E8 I6 X& U
第十条 中国公民具有下列条件之一的,可以经申请批准退出中国国籍:7 \1 s: P! g; k6 M( ^9 E- E3 S
一、外国人的近亲属;

- ` H$ e! _$ c# r) y# C 三、有其它正当理由。
1 y F4 @% M* J) S+ I" k2 [ 第十一条 申请退出中国国籍获得批准的,即丧失中国国籍。
8 F- j( g1 ~- ~# b) v" ` 第十二条 国家工作人员和现役军人,不得退出中国国籍。6 h3 e0 f l; c/ x! k
第十三条 曾有过中国国籍的外国人,具有正当理由,可以申请恢复中国国籍;被批准恢复中国国籍的,不得再保留外国国籍。4 n$ B, y& k# [ X2 c
第十四条 中国国籍的取得、丧失和恢复,除第九条规定的以外,必须办理申请手续。未满十八周岁的人,可由其父母或其他法定代理人代为办理申请。( \9 [( C9 j8 k
第十五条 受理国籍申请的机关,在国内为当地市、县公安局,在国外为中国外交代表机关和领事机关。
& ] T/ x0 A! `9 y& K; z1 Q 第十六条 加入、退出和恢复中国国籍的申请,由中华人民共和国公安部审批。经批准的,由公安部发给证书。" w8 z+ T+ E q3 _* U
第十七条 本法公布前,已经取得中国国籍的或已经丧失中国国籍的,继续有效。$ s" i& w V& S7 K
第十八条 本法自公布之日起施行。

This Law is applicable to the acquisition, loss and restoration of# w& D8 s; B. y" j. ~. n5 ?4 i

! j; t* I! h, ^4 c/ UThe People''s Republic of China is a unitary multinational state; persons% o4 z6 w0 S7 v" Y
belonging to any of the nationalities in China shall have Chinese. G1 m5 p9 `% M2 Y2 }

The People''s Republic of China does not recognize dual nationality for any, f1 F H) L3 O- l
Chinese national.

of whose parents is a Chinese national shall have Chinese nationality.) s, x5 R; `5 M# t! N, k

Any person born abroad whose parents are both Chinese nationals or one of
/ |) P+ `& d" P+ J, G6 o5 ?whose parents is a Chinese national shall have Chinese nationality. But a
6 @, @% T5 D+ I% dperson whose parents are both Chinese nationals and have both settled/ j' w- j: L0 e1 c! ]
abroad, or one of whose parents is a Chinese national and has settled# C; a7 G' Z* l. l. t
abroad, and who has acquired foreign nationality at birth shall not have

Any person born in China whose parents are stateless or of uncertain; @1 F3 }+ s3 Q) F, Y3 w f& i7 z
nationality and have settled in China shall have Chinese nationality.

8 F! D- d, W3 V2 VForeign nationals or stateless persons who are willing to abide by China''s
( f1 `6 v) w- I# UConstitution and laws and who meet one of the following conditions may be
$ ?6 ]( |' r# B7 {( ]naturalized upon approval of their applications:
' I0 ]% O( Y. \(1) they are near relatives of Chinese nationals;
+ q0 ~: C O- k+ T r; e(2) they have settled in China; or
# [8 [) q" X) b# p% k(3) they have other legitimate reasons.! Q; R; l, v; q U5 L1 \* B

Any person who applies for naturalization as a Chinese national shall
6 t+ n$ w5 N: S* |acquire Chinese nationality upon approval of his application; a person
( ~, r: M- J1 R" l0 b) o/ Rwhose application for naturalization as a Chinese national has been
- J$ T( K0 ~; I4 \! Oapproved shall not retain foreign nationality.

! h* r; \$ T7 ? kAny Chinese national who has settled abroad and who has been naturalized
% r V6 L. i7 eas a foreign national or has acquired foreign nationality of his own free
q( m$ m: l' }7 r5 |will shall automatically lose Chinese nationality.

Chinese nationals who meet one of the following conditions may renounce( F' N0 [7 \) `3 M% b1 Q
Chinese nationality upon approval of their applications:- M% O3 U4 x" L [$ V V. Z
(1) they are near relatives of foreign nationals;) R" U& N: @/ M5 y% e
(2) they have settled abroad; or
& j) z; A1 Q) P(3) they have other legitimate reasons.

Any person who applies for renunciation of Chinese nationality shall lose m; s9 ]& t0 y' T; Z
Chinese nationality upon approval of his application.; l2 v) _. h: }3 x! ?' A$ R

State functionaries and military personnel on active service shall not
# H' H0 @ b, n0 q9 Z0 urenounce Chinese nationality.8 K6 b1 N. m: s6 f. }. G4 N3 |
Article 138 v6 {* O* y) b. p4 U8 |( n4 h
Foreign nationals who once held Chinese nationality may apply for
+ A/ I. Y) [; M1 h' i' e& |: | wrestoration of Chinese nationality if they have legitimate reasons; those
8 v2 m9 V% I3 vwhose applications for restoration of Chinese nationality have been# @: G7 R' T' ]7 {5 N% e3 v
approved shall not retain foreign nationality.

Persons who wish to acquire, renounce or restore Chinese nationality, with
1 ~7 V' l! k+ Z7 p7 xthe exception of the cases provided for in Article 9, shall go through the7 z6 S1 J# X5 z, e' ]7 \1 H. h
formalities of application. Applications of persons under the age of 18
1 \) x1 M) [6 x* a' `may be filed on their behalf by their parents or other legal
# e2 O' _# ]- v2 q1 g. x' e, Grepresentatives.3 l8 c0 G/ P' w& ^5 P! T2 c; I6 f
Article 15: V2 H- v* B3 a/ j7 B8 l: P a
Nationality applications at home shall be handled by the public security
$ @' @) G5 |# A. g) bbureaus of the municipalities or counties where the applicants reside;
: ?# ^" I( Q3 T. M. X6 t! cnationality applications abroad shall be handled by China''s diplomatic
4 G; J" S( L0 L; w# ], L. @representative agencies and consular offices.$ }9 I3 G v6 m9 W( W7 B* @
Article 16
% k0 @! E( M0 L! E( dApplications for naturalization as Chinese nationals and for renunciation+ N. b H8 A( c! i9 G5 D
or restoration of Chinese nationality are subject to examination and1 m& }. b1 n1 I3 F( V2 {
approval by the Ministry of Public Security of the People''s Republic of
e1 n0 X' r" P) c7 sChina. The Ministry of Public Security shall issue a certificate to any
; @7 z9 }# @3 i' k) g0 i8 }1 Y/ qperson whose application has been approved.
8 Y/ u2 u9 O9 F: ?Article 17
/ a5 m \7 E2 F6 A2 iThe nationality status of persons who have acquired or lost Chinese7 r# Q. }7 X5 Q" W6 i q
nationality before the promulgation of this Law shall remain valid.

This Law shall come into force on the day of its promulgation. |
